아이속닥 서비스 이용약관

본 약관은 해피스트(이하 “회사”)가 운영하는 비공개 사진 공유 서비스(이하 “서비스”)의 이용과 관련하여 회사와 이용자 간의 권리, 의무 및 책임사항을 규정함을 목적으로 합니다.

제1조 목적

이 약관은 회사가 제공하는 서비스의 이용조건, 절차, 회사와 이용자의 권리·의무 및 기타 필요한 사항을 규정함을 목적으로 합니다.

제2조 정의

  1. 서비스란 회사가 모바일 애플리케이션 등을 통해 제공하는 사진·영상 공유 및 공유그룹간 소통을 위한 비공개 SNS를 의미합니다.
  2. 이용자란 본 약관에 동의하고 서비스를 이용하는 자를 말합니다.
  3. 회원이란 회사에 개인정보를 제공하고 계정을 생성하여 서비스를 이용하는 자를 말합니다.
  4. 공유그룹이란 회원이 초대 기능을 통해 생성·운영하는 비공개 소통 공간을 의미합니다.
  5. 콘텐츠란 회원이 서비스에 업로드하거나 공유하는 사진, 영상, 댓글, 메시지 등 일체의 정보를 말합니다.
  6. 아동이란 만 14세 미만의 자를 말합니다.
  7. 보호자(법정대리인)란 아동의 친권자 또는 법률상 보호 권한을 가진 자를 말합니다.

제3조 약관의 효력 및 변경

  1. 본 약관은 서비스 화면에 게시하거나 기타 방법으로 공지함으로써 효력이 발생합니다.
  2. 회사는 관련 법령을 위반하지 않는 범위에서 약관을 변경할 수 있으며, 변경 시 적용일자 및 변경사유를 명시하여 사전에 공지합니다.
  3. 이용자가 변경된 약관에 동의하지 않을 경우 서비스 이용을 중단하고 탈퇴할 수 있습니다.

제4조 회원가입 및 계정관리

  1. 회원가입은 이용자가 약관에 동의하고 회사가 정한 절차에 따라 계정을 생성함으로써 완료됩니다.
  2. 본 서비스는 보호자(법정대리인)를 통한 가입 및 이용을 전제로 하며, 회사는 만 14세 미만 아동의 개인정보를 법정대리인의 동의 없이 직접 수집하지 않습니다.
  3. 회원은 계정 정보에 대한 관리 책임을 가지며, 이를 제3자에게 공유하거나 양도할 수 없습니다.
  4. 회원은 자신이 업로드하거나 공유하는 아동의 사진·영상에 대해 적법한 보호자 권한을 보유하고 있음을 보증합니다.
  5. 회사는 다음 각 호의 경우 회원가입을 제한하거나 사후에 계정을 해지할 수 있습니다.
  • 허위 정보로 가입한 경우
  • 타인의 권리를 침해하거나 법령을 위반한 경우

제5조 서비스의 제공 및 변경

  1. 회사는 가족 그룹 기반의 사진·영상 공유 및 소통 기능을 제공합니다.
  2. 회사는 서비스의 품질 개선 또는 기술적 필요에 따라 서비스의 전부 또는 일부를 변경할 수 있습니다.
  3. 서비스는 원칙적으로 연중무휴 제공되나, 시스템 점검 등 불가피한 경우 일시 중단될 수 있습니다.

제6조 비공개 가족 그룹 및 초대

  1. 서비스는 기본적으로 비공개를 원칙으로 하며, 공유그룹에 초대된 회원만 콘텐츠를 열람할 수 있습니다.
  2. 그룹 생성자 또는 관리자는 그룹 초대 및 구성원 관리를 할 수 있습니다.
  3. 회사는 이용자 간의 사적 분쟁에 원칙적으로 개입하지 않으며, 관련 법령에 따라 필요한 조치를 취할 수 있습니다.
  4. 서비스 내 콘텐츠는 공유그룹 외의 제3자에게 공개되지 않으며, 회사는 공개형 피드, 검색 노출, 외부 공유 기능을 제공하지 않습니다.

제7조 콘텐츠의 권리 및 이용

  1. 회원이 서비스에 업로드한 콘텐츠의 저작권은 해당 회원에게 귀속됩니다.
  2. 회원은 자신이 서비스에 업로드한 콘텐츠를 서비스의 제공, 저장, 전송 및 공유그룹 내 회원 간 공유를 위해 필요한 범위에 한하여 회사가 비독점적으로 이용할 수 있도록 허용합니다.
  3. 회사는 해당 콘텐츠를 서비스 운영 목적 외의 용도로 이용하거나, 마케팅·홍보·AI 학습 등 어떠한 목적을 위해서도 제3자에게 제공하지 않습니다.
  4. 회사는 법령 위반 또는 약관 위반 콘텐츠를 사전 통지 없이 삭제하거나 접근을 제한할 수 있습니다.
  5. 회원이 콘텐츠를 삭제하거나 서비스에서 탈퇴한 경우, 해당 콘텐츠는 관련 법령 및 개인정보처리방침에 따라 지체 없이 접근이 제한되며, 일정 기간 내 완전 삭제됩니다.

제8조 유료 서비스 및 결제

  1. 회사는 일부 기능에 대해 유료 서비스를 제공할 수 있습니다.
  2. 유료 서비스의 이용요금, 결제방법, 환불정책은 별도로 안내합니다.
  3. 앱 스토어 수수료 및 결제 정책은 각 앱 스토어의 정책을 따릅니다.

제9조 이용자의 의무

이용자는 다음 행위를 하여서는 안 됩니다.

  1. 타인의 개인정보 또는 사진을 무단으로 업로드하는 행위
  2. 서비스의 정상적인 운영을 방해하는 행위
  3. 법령 또는 공서양속에 반하는 콘텐츠 게시
  4. 아동의 안전 또는 인권을 침해할 우려가 있는 사진·영상(과도한 노출, 사적 상황 등)을 게시하는 행위
  5. 보호자 동의 없이 제3자의 아동이 포함된 콘텐츠를 게시하는 행위

제10조 개인정보 보호

회사는 개인정보 보호 관련 법령을 준수하며, 개인정보의 수집·이용·보관에 관한 사항은 개인정보처리방침에 따릅니다.

제11조 서비스 이용 제한 및 해지

  1. 회사는 이용자가 본 약관을 위반한 경우 서비스 이용을 제한하거나 계정을 해지할 수 있습니다.
  2. 회원 탈퇴 시 개인정보 및 콘텐츠는 관련 법령 및 개인정보처리방침에 따라 접근이 제한되며, 일정 기간 보관 후 안전하게 삭제됩니다.

제12조 책임의 제한

  1. 회사는 천재지변, 시스템 장애 등 불가항력으로 인한 서비스 중단에 대해 책임을 지지 않습니다.
  2. 회사는 회원 간 또는 회원과 제3자 간 분쟁에 대해 책임을 지지 않습니다.
  3. 회사는 회원이 서비스에 게시한 콘텐츠의 정확성, 적법성에 대해 보증하지 않으며, 해당 콘텐츠로 인해 발생한 책임은 이를 게시한 회원에게 귀속됩니다.

제13조 준거법 및 관할

본 약관은 대한민국 법령을 준거법으로 하며, 서비스와 관련하여 발생한 분쟁은 회사의 본점 소재지를 관할하는 법원을 제1심 관할법원으로 합니다.

본 약관은 2026년 1월 1일부터 적용됩니다.

Aisokdak Terms of Service

These Terms of Service set out the rights, obligations, and responsibilities of the Company and Users in connection with use of the private photo-sharing service (the “Service”) operated by HAPPIEST (the “Company”).

Article 1. Purpose

The purpose of these Terms is to set out the conditions and procedures for using the Service provided by the Company, the rights and obligations of the Company and Users, and other necessary matters.

Article 2. Definitions

  1. “Service” means the private social networking service provided by the Company through mobile applications and other means for sharing photos and videos and communicating between Sharing Groups.
  2. “User” means a person who agrees to these Terms and uses the Service.
  3. “Member” means a person who provides personal information to the Company, creates an account, and uses the Service.
  4. “Sharing Group” means a private communication space created and operated by a Member through the invitation feature.
  5. “Content” means all information, including photos, videos, comments, and messages, that a Member uploads to or shares through the Service.
  6. “Child” means a person under 14 years of age.
  7. “Guardian (legal representative)” means a Child’s parent with parental authority or a person with legal authority to protect the Child.

Article 3. Effect and Amendment of the Terms

  1. These Terms take effect when posted on the Service screen or announced by other means.
  2. The Company may amend these Terms to the extent that the amendments do not violate applicable laws. When amending them, the Company will specify the effective date and reasons for the changes and give advance notice.
  3. If a User does not agree to the amended Terms, the User may stop using the Service and withdraw.

Article 4. Membership and Account Management

  1. Membership is completed when a User agrees to these Terms and creates an account according to the procedures set by the Company.
  2. The Service is intended to be joined and used through a Guardian (legal representative). The Company does not collect personal information directly from a Child under 14 without the consent of the Child’s legal representative.
  3. Members are responsible for managing their account information and may not share or transfer it to a third party.
  4. Members warrant that they have lawful Guardian authority over photos and videos of Children that they upload or share.
  5. The Company may restrict membership registration or later terminate an account in any of the following cases.
  • The person registered with false information
  • The person infringed another person’s rights or violated laws

Article 5. Provision and Changes to the Service

  1. The Company provides photo and video sharing and communication features based on family groups.
  2. The Company may change all or part of the Service to improve its quality or meet technical needs.
  3. In principle, the Service is available year-round, but may be temporarily suspended when unavoidable, such as for system maintenance.

Article 6. Private Family Groups and Invitations

  1. The Service is private by default, and only Members invited to a Sharing Group may view its Content.
  2. The group creator or administrator may invite people to the group and manage its members.
  3. In principle, the Company does not intervene in private disputes between Users, but may take necessary measures in accordance with applicable laws.
  4. Content within the Service is not disclosed to third parties outside a Sharing Group, and the Company does not provide public feeds, search visibility, or external sharing features.

Article 7. Rights to and Use of Content

  1. Copyright in Content uploaded to the Service by a Member belongs to that Member.
  2. A Member permits the Company to use Content uploaded by that Member on a non-exclusive basis, only to the extent necessary to provide, store, transmit, and share it among Members within a Sharing Group.
  3. The Company does not use such Content for purposes other than operating the Service or provide it to third parties for any purpose, including marketing, promotion, or AI training.
  4. The Company may delete Content that violates laws or these Terms, or restrict access to it, without prior notice.
  5. If a Member deletes Content or withdraws from the Service, access to that Content will be restricted without delay in accordance with applicable laws and the Privacy Policy, and it will be completely deleted within a certain period.

Article 8. Paid Services and Payments

  1. The Company may offer paid services for certain features.
  2. Fees, payment methods, and refund policies for paid services will be announced separately.
  3. App store fees and payment policies are subject to each app store’s policies.

Article 9. User Obligations

Users must not engage in the following activities.

  1. Uploading another person’s personal information or photos without authorization
  2. Interfering with the normal operation of the Service
  3. Posting Content that violates laws or public order and morals
  4. Posting photos or videos that may threaten a Child’s safety or human rights, such as excessive exposure or private situations
  5. Posting Content that includes another person’s Child without the Guardian’s consent

Article 10. Personal Information Protection

The Company complies with laws relating to personal information protection. The Privacy Policy governs matters concerning the collection, use, and retention of personal information.

Article 11. Restrictions on and Termination of Service Use

  1. If a User violates these Terms, the Company may restrict the User’s use of the Service or terminate the account.
  2. When a Member withdraws, access to personal information and Content is restricted in accordance with applicable laws and the Privacy Policy, and the information and Content are securely deleted after being retained for a certain period.

Article 12. Limitation of Liability

  1. The Company is not liable for Service interruptions caused by force majeure, such as natural disasters or system failures.
  2. The Company is not liable for disputes between Members or between a Member and a third party.
  3. The Company does not warrant the accuracy or lawfulness of Content posted by Members on the Service. Responsibility for any consequences arising from such Content belongs to the Member who posted it.

Article 13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Korea. Any dispute arising in connection with the Service will be heard by the court with jurisdiction over the location of the Company’s head office as the court of first instance.

These Terms take effect on January 1, 2026.
